The term “coercion” implies some form or level of physical or psychological violence, while the expression “lenyűgöz” rather refers to a non-violent way of overcoming a person’s free will, by enchanting or charming them (captivating).

A fenyegetés fogalmát a törvény értelmező rendelkezései határozzák meg: a fenyegetés olyan súlyos hátrány kilátásba helyezése, amely alkalmas arra, hogy a megfenyegetettben komoly félelmet keltsen [Btk. 138. §]. Kényszer alatt valamely személyre közvetlenül ható fizikai erő
kifejtését kell érteni [BK. 93.]. Mind a kényszer, mind a fenyegetés hatását tekintve lehet akaratot megtörő (ún. vis absoluta-ként ható), illetőleg akaratot hajlító (ún. vis compulsivaként ható), de a beszámítási képességet kizáró hatása csak az akaratot megtörő változatoknak
van. (Az akaratot hajlító kényszer/fenyegetés esetén elvárhatóságot kizáró ok hatályosul.)
