I might recast the sentence (you definitely don't need "childbirth"):
The law requires the employer to provide maternity leave and to pay the employee's average salary during such leave.
This also raises the question of the period over which the average should be calculated.

I checked with Google for "maternity and childbirth leave", "childbirth and maternity leave" and "maternity leave". I also checked with multitran and Lingvo. The overwhelming vote is for "maternity leave", so you are on safe ground!
"while maintaining THEIR average salary" or "the employee's average salary" would be fine. "The" on its own sounds odd to me, because there would not normally be any need for an article.

I don't think it makes much difference. "retaining" implies that they had an average salary, whereas it may have varied, and "maintaining" has more of the meaning of "paying", but the distinction is very slight.
The law requires the employer to provide maternity leave and to pay the employee's average salary during such leave.
This also raises the question of the period over which the average should be calculated.
