Situatia e urmatoarea: clientul a solicitat in Germania o procura cu incheiere Beurkundung (autentificare) si nu cu Beglaubigung (legalizare a semnaturii), pentru ca asa i-au cerut in Romania. A primit un document care se numeste Öffentliche Urkunde, care pe eur-lex si pe alte site-uri apare ca "act autentic".

Definitia lui Öffentliche Urkunde:
Öffentliche Urkunden sind Urkunden, die von einer öffentlichen Behörde innerhalb der Grenzen ihrer Amtsbefugnisse oder von einer mit öffentlichem Glauben versehenen Person innerhalb des ihr zugewiesenen Geschäftskreises in der vorgeschriebenen Form aufgenommen sind (§ 415 ZPO@, gesetzliche Definition).
Öffentliche Urkunden haben Beweiskraft für den Inhalt und die darin bezeugten Vorgänge und Tatsachen (§ 415 ZPO@).

Definitia actului autentic:
Mijloc de proba din categoria inscrisurilor prevazute in art.1171 si urm. C. civ.. Potrivit legii, actul autentic este acela care s-a facut cu solemnitatile cerute de lege de un functionar public, care are dreptul de a functiona in locul unde s-a facut.Cu privire la autentificare a se vedea Legea nr.36/1995, notarul public fiind competent sa autentifice un act.

Dilema mea: Este corecta corespondenta intre Öffentliche Urkunde si Act autentic? Intelegeam Öffentliche Urkunde ca document oficial/public. In plus, in textul apostilei, öffentliche Urkunde este act oficial. Procura din Germania are pe prima pagina Urkundenrolle Nr. XYZ, titlul de Öffentliche Urkunde, apoi la final sigiliul notarului (fara vreo incheiere aparte) si apostila.
