VISTO la Ley Nº 16.463, sus Decretos Reglamentarios Nº 9763/64, 150/92 (texto ordenado 1993), las
Disposiciones ANMAT Nros. 3185/99, 5040/06, 758/09, 4133/12, 1918/13, 2434/13 y 6766/16, sus complementarias
y modificatorias y el Ex-2018-22595718-APN-ANMAT#MS del Registro de esta Administración Nacional de
Medicamentos, Alimentos y Tecnología Médica; y
CONSIDERANDO:
Que la aplicación de las normativas aludidas tienen como finalidad última la protección de la salud de la población,
mediante la adopción de un modelo fiscalizador de gestión, que destine los mayores esfuerzos a garantizar la
eficacia, seguridad y calidad de los productos que aquella consume.
Que por Disposición ANMAT Nº 3185/99 se establecieron las exigencias de estudios de
Biodisponibilidad/Bioequivalencia entre productos y se adoptó el criterio para su implementación gradual de
acuerdo al riesgo sanitario de su ingrediente farmacéutico activo (IFA).
Que la aplicación efectiva de las Disposiciones ANMAT Nº 3185/99 y 2814/02 ha permitido el desarrollo, ejecución
y evaluación de los resultados de los estudios de Bioequivalencia en medicamentos que las empresas titulares de
Registros de Especialidades Medicinales (REM) han presentado para su inscripción ante esta Administración
Nacional.
Que mediante las Disposiciones ANMAT Nros. 3185/99 y 5040/06 y su modificatoria Nº 1746/07 se establecieron
los requerimientos técnicos y metodológicos para la adecuada realización de los estudios in vivo.
Que mediante las Disposiciones ANMAT Nros. 758/09 y 6766/16 se se establecieron las condiciones por las cuales
las formulaciones proporcionalmente similares al producto multifuente, que ha probado ser bioequivalente al
producto comparador de referencia, puedan demostrar su equivalencia mediante estudios in vitro.
Que como consecuencia de la implementación del Programa de Bioequivalencia comenzado en el año 1999 se han
instalado en el país centros clínicos y bioanalíticos equipados y adaptados para la realización de estudios de
Bioequivalencia.
Que la experiencia recogida en este proceso posibilita continuar con el desarrollo del Programa de Bioequivalencia,
adaptándolo a las circunstancias y a los conocimientos científicos actuales.
Que de acuerdo con los lineamientos internacionalmente aceptados y la normativa vigente, corresponde establecer
el procedimiento a seguir para aquellos productos que se presenten para su inscripción en el Registro de
Especialidades Medicinales (REM) y que en su composición cuenten con ingredientes farmacéuticos activos (IFAs)
nuevos para el mercado nacional.
Que el Instituto Nacional de Medicamentos y la Dirección General de Asuntos Jurídicos han tomado la intervención
de su competencia.
Que se actúa en virtud de las facultades conferidas por el Decreto Nº 1490/92 y el Decreto Nº 101 del 16 de
diciembre de 2015.
Por ello,
EL ADMINISTRADOR NACIONAL DE LA ADMINISTRACIÓN NACIONAL DE MEDICAMENTOS, ALIMENTOS
Y TECNOLOGÍA MÉDICA
DISPONE:
ARTÍCULO 1º.- Establécese que las Especialidades Medicinales que contengan uno o más Ingredientes
Farmacéuticos Activos (IFA`s) de origen sintético y/o semisintético, autorizadas por primera vez en el REM y para
las formas farmacéuticas que requieran estudios de bioequivalencia conforme a la normativa vigente, deberán
acreditar, al momento de solicitarse la autorización del primer lote en el marco de la Disposición ANMAT
N° 5743/09, la iniciación del trámite correspondiente a la Disposición ANMAT N° 1918/13 a los fines de su
evaluación como producto de referencia.
ARTÍCULO 2º.- Establécese que en las solicitudes de inscripción en el REM de medicamentos multifuente de
productos que correspondan a IFAs autorizados por primera vez en el mercado argentino, y con producto de
referencia declarado conforme a la normativa aplicable, deberá incluirse la acreditación del inicio del trámite
correspondiente a la autorización del protocolo del estudio de equivalencia in vivo o in vitro, según los
requerimientos de las disposiciones vigentes.
ARTÍCULO 3º.- Establécese para los productos referidos en el artículo 2º, que cuando se presenten solicitudes de
autorización del primer lote en el marco de la Disposición ANMAT N° 5743/09, se deberá presentar la disposición
emitida por esta Administración Nacional que los declare equivalentes al producto de referencia, previamente
establecido de acuerdo al artículo 1° de la presente disposición, en base a los estudios de equivalencia in vivo o in
vitro realizados.
ARTÍCULO 4°.- Esta Administración Nacional podrá plantear consideraciones especiales para la realización de
estudios de bioequivalencia relativos/referidos a aspectos éticos, clínicos o estadísticos entre otros.
ARTÍCULO 5º.- La presente disposición entrará en vigencia a partir del día siguiente al de su publicación en el
Boletín Oficial.
ARTÍCULO 6°.- Regístrese. Dése a la Dirección Nacional del Registro Oficial para su publicación. Notifíquese a las
Cámaras de Especialidades Medicinales (CILFA, CAEME, COOPERALA, CAPGEN, CAPEMVeL, SAFYBI),
Confederación Médica de la República Argentina (COMRA) y la Confederación Farmacéutica Argentina (COFA).

HAVING SEEN Act N° 16,406, its Regulatory Decrees N° 9763/64, 150/92 (ordered text 1993), ANMAT Dispositions N° 3185/99, 5040/06, 758/09, 4133/12, 1918/13, 2434/13 and 6766/16, their supplementary and amending dispositions, and Ex-2018-22595718-APN-ANMAT#MS of the Registry of this National Administration of Medicines, Food and Medical Technology; and
CONSIDERING:
That the implementation of the above-mentioned regulations is ultimately intended to protect the health of the population, by way of the adoption of a management controlling model, which commits the best efforts to ensure the efficacy, safety and quality of the products consumed by such.
That through ANMAT Disposition N° 3185/99, the requirements for the conduct of bioavailability/bioequivalence studies among products have been established and the criteria for their gradual implementation, based on the sanitary risk of the active pharmaceutical ingredient (API) therein contained, have been adopted.
That the effective implementation of ANMAT Dispositions N° 3185/99 and 2814/02, has enabled the development, execution and evaluation of the results from bioequivalence studies conducted on drug products that the companies holders of Medicinal Specialty Registries (REM, by its Spanish acronym) have submitted for their registration before this National Administration.
That through ANMAT Dispositions N° 3185/99 and 5040/06 and their amending disposition Nº 1746/07, the technical and methodological requirements for the proper conduct of in vivo studies have been established.
That through ANMAT Dispositions N° 758/09 and 6766/16, the conditions under which formulations proportionally similar to the multi-source product, which has proved to be bioequivalent to the reference comparator product, may demonstrate their equivalence by way of in vitro studies, have been established.
That, as a result of the implementation of the Bioequivalence Program in 1999, clinical and bioanalytical centers equipped and suited for the conduct of bioequivalence studies have been established.
That based on the experience gained in this process, it is possible to continue with the development of the Bioequivalence Program, adjusting such to the current circumstances and scientific knowledge.
That in agreement with the internationally accepted guidelines and the current regulations, the establishment of the procedure to be followed by those products that are submitted for their registration in the Medicinal Specialty Registry (REM, by its Spanish acronym) and which composition contains new active pharmaceutical ingredients (APIs) for the local market, is applicable.
That the National Institute of Medicines and the General Directorate of Legal Affairs have taken intervention based on their jurisdiction.
That the party hereto acts by virtue of the powers granted by Decree N° 1490/92 and Decree Nº 101 dated 16 December 2015.
Therefore,
THE NATIONAL ADMINISTRATOR OF THE NATIONAL ADMINISTRATION OF MEDICINES, FOOD AND MEDICAL TECHNOLOGY
HEREBY PROVIDES
SECTION 1 - That the medicinal specialties containing one or more synthetic or semi-synthetic active pharmaceutical ingredients (APIs), authorized for the first time in the REM and for pharmaceutical forms requiring bioequivalence studies based on the current regulations, must submit, at the time of requesting the authorization for the first batch under ANMAT Disposition N°
N° 5743/09, evidence of the commencement of the proceeding related to ANMAT Disposition N° 1918/13 for their evaluation as reference product.
SECTION 2 - That it is hereby established that evidence of the commencement of the proceeding referred to the authorization of in vivo or in vitro equivalence study protocol must be included, as per the requirements of the current dispositions, in the requests for registration in the REM of multi-source drug products for products that refer to APIs authorized for the first time in the Argentine market and to the reference product declared in agreement with the applicable regulation.
SECTION 3 - That it is hereby established that for the products mentioned in Section 2 that, when requests for authorization of the first batch are submitted under ANMAT Disposition N° 5743/09, the disposition issued by this National Administration declaring them equivalent to the reference product, as previously set forth in agreement with Section 1 of this disposition, based on in vivo or in vitro equivalence studies conducted, must be submitted.
SECTION 4 - This National Administration may raise special considerations for the conduct of bioequivalence studies related/referred to ethical, clinical or statistical aspects, among others.
SECTION 5 - This Disposition shall be effective as of the day following its publication in the Official Bulletin.
SECTION 6 - This should be registered. This Disposition should be addressed to the National Directorate of the Official Registry for publication purposes. This should be notified to the Medicinal Specialty Chambers (Camara de Especialidades Medicinales) (CILFA, CAEME, COOPERALA, CAPGEN, CAPEMVeL, SAFYBI), the Medical Confederation of the Argentine Republic (Confederacion Medica de la Republica Argentina) (COMRA) and the Argentine Pharmaceutical Confederation (Confederacion Farmaceutica Argentina) (COFA).
This Disposition should be submitted to the INAME and the Directorate of Institutional Relations and Publicity Regulation. Once complied with, this should be filed. Carlos Alberto Chiale
