Pytania:
Przesłanki, tryb i terminy zaskarżania pozwolenia na budowę – w jak długiej perspektywie czasu należy liczyć się z możliwością zaskarżenia/unieważnienia pozwolenia na budowę.
Prośba również o opisanie przesłanek ważności pozwolenia na budowę i najczęściej spotykanych w praktyce przyczyn jej unieważnienia (uchylenia).
1 Podmioty uprawnione do wniesienia odwołania
Roboty budowlane może rozpocząć na podstawie ostatecznej decyzji o pozwoleniu na budowę; decyzja jest ostateczna jeśli nie służy od niej odwołanie (art. 16 § 1 k.p.a.). Taka sytuacja ma miejsce co do zasady wtedy, gdy upłynął już termin na wniesienie odwołania (i nie został przywrócony), czy też decyzja o pozwoleniu na budowę została utrzymana w mocy w wyniku rozpatrzenia odwołania przez organ II instancji (skarga do sądu administracyjnego nie wstrzymuje - co do zasady – wykonania decyzji). Kwestia nadania decyzji o pozwoleniu na budowę rygoru natychmiastowej wykonalności wzbudza wątpliwości prawne. W konsekwencji nie będzie omawiany wariant gdzie pozwolenie na budowę ITPOK zostanie wydane z rygorem natychmiastowej wykonalności.
Od decyzji o pozwoleniu na budowę stronom służy odwołanie, składane w terminie 14 dni od doręczenia lub obwieszczenia decyzji. Tylko strona postępowania może wnieść odwołanie od decyzji o pozwoleniu na budowę. Co do zasady, zgodnie z art. 28 ust. 2 Prawa budowlanego (dalej jako „PrBud”), stronami w postępowaniu w sprawie pozwolenia na budowę są: inwestor oraz właściciele, użytkownicy wieczyści lub zarządcy nieruchomości znajdujących się w obszarze oddziaływania obiektu. Jak orzekł NSA w wyroku z dnia 9 października 2007 r., sygn. II OSK 1321/06 "wyznaczenie obszaru oddziaływania obiektu winno nastąpić, biorąc pod uwagę funkcję, formę, konstrukcję projektowanego obiektu i inne jego cechy charakterystyczne oraz sposób zagospodarowania terenu znajdującego się w otoczeniu projektowanej inwestycji, uwzględniają treść nakazów i zakazów zawartych w przepisach odrębnych". Koniecznym jest zatem każdorazowe ustalenie przepisów odrębnych, które wprowadzają przewidujące w konkretnej sytuacji ograniczenia w swobodnym korzystaniu z nieruchomości ze względu na powstanie w sąsiedztwie określonego obiektu budowlanego. Podstawę do uczestnictwa w charakterze strony w postępowaniu zmierzającym do wydania decyzji o pozwoleniu na budowę dają tylko ograniczenia w zagospodarowaniu nieruchomości wynikające z konkretnego przepisu prawa. Tylko wówczas bowiem mamy do czynienia z istnieniem interesu prawnego. Ograniczenia, które nie wynikają z przepisów prawnych nie stanowią podstawy do uznania podmiotu za stronę takiego postępowania, ponieważ istnieje wówczas interes faktyczny a nie prawny (tak też - wyroki Naczelnego Sądu Administracyjnego: z dnia 25 września 2008 r., II OSK 1058/07; z dnia 16 marca 2009 r., II OSK 1540/08, II OSK 12/08; z 4 września 2009 r. sygn. II OSK 1349/08, wyrok WSA w Lublinie z 25 września 2009 r., sygn. akt II SA/Lu 322/09). A zatem PrBud istotnie zawęża możliwość uzyskania statusu strony w postępowaniu o pozwolenie na budowę, a co za tym idzie – możliwość wniesienia odwołania. PrBud wyłącza też (co do zasady) z uczestnictwa w postępowaniach o pozwolenia na budowę organizacje ekologiczne, które niejednokrotnie (w praktyce) składały odwołania (art. 28 ust. 3 PrBud).
Jednak wyżej opisanych ograniczeń w statusie strony, przewidzianych art. 28 ust. 2 i ust. 3 PrBud, nie stosuje się w postępowaniu w sprawie pozwolenia na budowę wymagającego udziału społeczeństwa zgodnie z przepisami ustawy z dnia 3 października 2008 r. o udostępnianiu informacji o środowisku i jego ochronie, udziale społeczeństwa w ochronie środowiska oraz o ocenach oddziaływania na środowisko (dalej jako „UstInforŚrod”). W takim przypadku stosuje się bowiem przepisy UstInforŚrod i ogólne przepisy k.p.a. o stronie (art. 28). Jak wynika zaś z wydanej dla ITPOK decyzji o środowiskowych uwarunkowaniach z dnia 15 kwietnia 2010 r. (dalej jako „Decyzja Środowiskowa”), na inwestora nałożono obowiązek przeprowadzenia ponownej oceny oddziaływania na środowisko w ramach postępowania o pozwolenie na budowę (s. 16 i s. 36 Decyzji Środowiskowej) w związku z postanowieniem Regionalnego Dyrektora Ochrony Środowiska (na podstawie art. 77 ust. 5 UstInforŚrod). Zgodnie z art. 3 pkt 8) lit. c UstInforŚrod - postępowanie w sprawie oceny oddziaływania na środowisko planowanego przedsięwzięcia obejmuje w szczególności zapewnienie możliwości udziału społeczeństwa w postępowaniu . W konsekwencji przyjąć należy , że w postępowaniu na prawach strony będą mogły uczestniczyć organizacje ekologiczne a także inne podmioty, które wykażą spełnienie kryterium interesu prawnego w rozumieniu art. 28 k.p.a. Na podstawie art. 44 ust. 1 UstInforŚrod - organizacje ekologiczne, które powołując się na swoje cele statutowe, zgłoszą chęć uczestniczenia w postępowaniu o pozwolenie na budowę (wymagającym udziału społeczeństwa), będą w nim uczestniczyły na prawach strony. Zgodnie z art. 44 ust. 2 UstInforŚrod - organizacji ekologicznej służy prawo wniesienia odwołania od decyzji wydanej w postępowaniu wymagającym udziału społeczeństwa, jeżeli jest to uzasadnione celami statutowymi tej organizacji, także w przypadku, gdy nie brała ona udziału w określonym postępowaniu wymagającym udziału społeczeństwa prowadzonym przez organ pierwszej instancji; wniesienie odwołania jest równoznaczne ze zgłoszeniem chęci uczestniczenia w takim postępowaniu. W postępowaniu odwoławczym organizacja uczestniczy na prawach strony.
Jak wynika z uzasadnienia Decyzji Środowiskowej (s. 22-23), w postępowaniu o jej wydanie wzięło udział pięć organizacji ekologicznych. Można się spodziewać, że organizacje te wezmą także udział w postępowaniu o pozwolenie na budowę i będą wnosiły odwołania, jeżeli ich uwagi/wnioski nie zostaną uwzględnione. Jak wynika z uzasadnienia Decyzji Środowiskowej (s. 33 i nast.), inwestycja znajduje się w sąsiedztwie obszarów ochrony siedlisk Natura 2000: Fortyfikacje w Poznaniu, które są miejscem zimowania nietoperzy. W Decyzji Środowiskowej stwierdzono, że ITPOK nie będzie miał negatywnego wpływu na nietoperze (potencjalne zagrożenie hałasem), ale sam fakt ich występowania może wzbudzić zainteresowanie organizacji ekologicznych udziałem w postępowaniu i wnoszeniem odwołań.
Ponadto, w postępowaniu wymagającym udziału społeczeństwa (a takim będzie najprawdopodobniej postępowanie o pozwolenie na budowę ITPOK) każdy ma prawo składania uwag i wniosków (art. 29 i art. 5 UstInforŚrod). Nie oznacza to automatycznie prawa do składania odwołania od decyzji o pozwoleniu na budowę (konieczne jest bowiem jeszcze spełnienie kryterium interesu prawnego), ale może to w pewnym stopniu wydłużyć procedurę wydawania samego pozwolenia. Zgodnie z art. 30 UstInforŚrod - organy administracji właściwe do wydania decyzji lub opracowania projektów dokumentów, w przypadku których przepisy niniejszej ustawy lub innych ustaw wymagają zapewnienia możliwości udziału społeczeństwa, zapewniają możliwość udziału społeczeństwa odpowiednio przed wydaniem tych decyzji lub ich zmianą oraz przed przyjęciem tych dokumentów lub ich zmianą. Po wniesieniu uwag i wniosków właściwy organ:
1) rozpatruje uwagi i wnioski wniesione przez społeczeństwo ;
2) dołącza do przyjętego dokumentu uzasadnienie zawierające informacje o udziale społeczeństwa w postępowaniu oraz o tym, w jaki sposób zostały wzięte pod uwagę i w jakim zakresie zostały uwzględnione uwagi i wnioski zgłoszone w związku z udziałem społeczeństwa.
Warto zwrócić uwagę, że w Decyzji Środowiskowej opis złożonych uwag i odpowiedzi inwestora na te uwagi zajmuje ponad 100 stron, co obrazuje skalę wpływu „udziału społeczeństwa” na termin wydania decyzji o pozwoleniu na budowę.
2 Odwołanie od decyzji o pozwoleniu na budowę, terminy na wniesienie odwołania, skarga do sądu administracyjnego
Odwołanie od decyzji o pozwoleniu na budowę wydanej przez prezydenta miasta rozpatruje wojewoda (z tym, że jest pewna kategoria inwestycji gdzie pozwolenie na budowę wydaje w I instancji wojewoda – art. 82 ust. 3 PrBud). Odwołanie może być wniesione wyłącznie przez stronę postępowania o pozwolenie na budowę (o czym wyżej w pkt 1 niniejszego opracowania) w terminie 14 dni od doręczenia lub obwieszczenia decyzji. Odwołanie wnosi się za pośrednictwem organu I instancji.
Odwołanie nie wymaga szczegółowego uzasadnienia. Wystarczy, jeżeli z odwołania wynika, że strona nie jest zadowolona z wydanej decyzji (art. 128 k.p.a.). W praktyce, podmioty wnoszące odwołania w sprawach o pozwolenia na budowę często powołują się na naruszenie ogólnych zasad k.p.a. (art. 6 – 16), w tym m.in.:
- zasady praworządności,
- zasady prawdy obiektywnej,
- zasady pogłębiania zaufania,
- zasady udzielania informacji,
- zasady wysłuchania stron.
Naruszenie tych zasad jest prostsze do ogólnego uzasadnienia i choć zwykle nie stanowi podstawy do definitywnego pozbawienia inwestora możliwości utrzymania w mocy pozwolenia na budowę, to niemniej może skłonić organ II instancji do uchylenia decyzji i przekazania sprawy do ponownego rozpatrzenia sprawy organowi I instancji, co z kolei znacznie wydłuży postępowanie.
Podstawami odwołania są także bardzo często przepisy Rozporządzenia Ministra Infrastruktury z dnia 12 kwietnia 2002 r. w sprawie warunków technicznych, jakim powinny odpowiadać budynki i ich usytuowanie (dalej jako „RozpWarTechBud”) w tym m.in.: nadmierne zacienienie powodowane przez powstający obiekt, nadmierne hałasy, niespełnienie norm bezpieczeństwa przeciw-pożarowego, itp. Odwołujący dokonują wnikliwych analiz projektu budowlanego i wskazują w jakich miejscach jest on niezgody z RozpWarTechBud.
W sprawach gdzie istotną rolę odgrywają przepisy o ochronie środowiska (a do takich niewątpliwie zalicza się ITPOK) częstymi podstawami są przepisy z ustaw regulujących środowisko i ochronę środowiska, w tym w zakresie: hałasów, odorów, wpływu na stosunki wodne, itp. W przedmiotowej sprawie listę potencjalnych argumentów do odwołań dostarczają uwagi i wnioski zgłoszone w toku postępowania o Decyzję Środowiskową i tam opisane.
Wniesienie odwołania w terminie wstrzymuje wykonanie decyzji (art. 130 § 2 k.p.a.), tj. możliwość rozpoczęcia robót budowlanych objętych pozwoleniem na budowę. O wniesieniu odwołania organ administracji publicznej, który wydał decyzję, zawiadamia strony.
Odwołanie powinno zostać rozpatrzone przez organ II instancji w terminach określonych w art. 35 k.p.a., tj.:
- niezwłocznie powinny być załatwiane sprawy, które mogą być rozpatrzone w oparciu o dowody przedstawione przez stronę łącznie z żądaniem wszczęcia postępowania lub w oparciu o fakty i dowody powszechnie znane albo znane z urzędu organowi, przed którym toczy się postępowanie, bądź możliwe do ustalenia na podstawie danych, którymi rozporządza ten organ,
- załatwienie sprawy wymagającej postępowania wyjaśniającego powinno nastąpić nie później niż w ciągu miesiąca, a sprawy szczególnie skomplikowanej - nie później niż w ciągu dwóch miesięcy od dnia wszczęcia postępowania, zaś w postępowaniu odwoławczym - w ciągu miesiąca od dnia otrzymania odwołania,
- jednak do terminów wyżej określonych nie wlicza się terminów przewidzianych w przepisach prawa dla dokonania określonych czynności, okresów zawieszenia postępowania oraz okresów opóźnień spowodowanych z winy strony albo z przyczyn niezależnych od organu.
Niejednokrotnie rozpatrzenie odwołania trwa znacznie dłużej niż przewidziany maksymalnie w k.p.a. jeden miesiąc.
Należy też wspomnieć, że po wyczerpaniu środków zaskarżenia przewidzianych w k.p.a. (odwołanie), tzn. jeżeli np. organ drugiej instancji utrzyma zaskarżoną decyzję o pozwoleniu na budowę w mocy, uprawnionemu przysługuje skarga do wojewódzkiego sądu administracyjnego (art. 52 § 1 ustawy - Postępowanie przed sądami administracyjnymi – dalej jako „PostSAdm”). Termin na wniesienie skargi to 30 dni od doręczenia skarżącemu rozstrzygnięcia w sprawie lub 6 miesięcy dla prokuratora, czy RPO. Skargę wnosi się za pośrednictwem organu, którego działanie jest przedmiotem skargi. Co do zasady, wniesienie skargi do WSA nie wstrzymuje wykonania pozwolenia na budowę (art. 61 § 1 PostAdm). Jednak w pewnych okolicznościach możliwe jest wstrzymanie wykonania pozwolenia na budowę (art. 61 § 2 i § 3 PostAdm).
Zgodnie z art. 44 ust. 3 UstInforŚrod - organizacji ekologicznej służy skarga do sądu administracyjnego od decyzji wydanej w postępowaniu wymagającym udziału społeczeństwa, jeżeli jest to uzasadnione celami statutowymi tej organizacji, także w przypadku, gdy nie brała ona udziału w określonym postępowaniu wymagającym udziału społeczeństwa.
W praktyce zdarza się, że organ II instancji uchyla decyzję o pozwoleniu na budowę z uwagi na naruszenie zasad postępowania, albo brak wyjaśnienia istotnych w sprawie okoliczności i przekazuje sprawę do ponownego rozstrzygnięcia organowi I instancji. Organ I instancji powtarza postępowanie w części określonej wytycznymi organu II instancji i ponownie wydaje decyzję o pozwoleniu na budowę. Tę decyzję ponownie zaskarża odwołaniem strona. Organ II instancji po przeprowadzeniu kolejnego postępowania odwoławczego utrzymuje decyzję o pozwoleniu na budowę, ale strona składa skargę do WSA z wnioskiem o wstrzymanie wykonalności decyzji o pozwoleniu na budowę (choć z tego tytułu może być zobligowana do wniesienia kaucji na zabezpieczenie roszczeń inwestora wg art. 35a PrBud). WSA zaś po kilkunastomiesięcznym postępowaniu uchyla decyzję o pozwoleniu na budowę. W takim scenariuszu rozpatrywanie sprawy wniosku o pozwolenie na budowę trwa kilka lat.
3 Unieważnienie decyzji o pozwoleniu na budowę; wznowienie postępowania
Poza odwołaniem do organu II instancji i skargą do WSA, w stosunku do prawomocnych decyzji o pozwoleniu na budowę mogą być także składane żądania ich unieważnienia albo wnioski o wznowienie postępowania w sprawie.
Stwierdzenie nieważności pozwolenia na budowę
Zgodnie z art. 156 § 1 k.p.a. - organ administracji publicznej stwierdza nieważność decyzji, która:
1) wydana została z naruszeniem przepisów o właściwości,
2) wydana została bez podstawy prawnej lub z rażącym naruszeniem prawa,
3) dotyczy sprawy już poprzednio rozstrzygniętej inną decyzją ostateczną,
4) została skierowana do osoby nie będącej stroną w sprawie,
5) była niewykonalna w dniu jej wydania i jej niewykonalność ma charakter trwały,
6) w razie jej wykonania wywołałaby czyn zagrożony karą,
7) zawiera wadę powodującą jej nieważność z mocy prawa.
Nie stwierdza się nieważności decyzji z przyczyn wymienionych w § 1 pkt 1, 3, 4 i 7, jeżeli od dnia jej doręczenia lub ogłoszenia upłynęło dziesięć lat, a także gdy decyzja wywołała nieodwracalne skutki prawne.
Zgodnie z art. 158 § 2 k.p.a. - jeżeli nie można stwierdzić nieważności decyzji na skutek okoliczności, o których mowa w art. 156 § 2, organ administracji publicznej ograniczy się do stwierdzenia wydania zaskarżonej decyzji z naruszeniem prawa oraz wskazania okoliczności, z powodu których nie stwierdził nieważności decyzji.
Zgodnie zaś z art. 159 § 1 k.p.a. - organ administracji publicznej, właściwy w sprawie stwierdzenia nieważności decyzji, wstrzyma z urzędu lub na żądanie strony wykonanie decyzji, jeżeli zachodzi prawdopodobieństwo, że jest ona dotknięta jedną z wad wymienionych w art. 156 § 1.
Wznowienie postępowania o pozwolenie na budowę
Zgodnie z art. 145 § 1 k.p.a. - w sprawie zakończonej decyzją ostateczną wznawia się postępowanie , jeżeli:
1) dowody, na których podstawie ustalono istotne dla sprawy okoliczności faktyczne, okazały się fałszywe,
2) decyzja wydana została w wyniku przestępstwa,
3) decyzja wydana została przez pracownika lub organ administracji publicznej, który podlega wyłączeniu stosownie do art. 24, 25 i 27,
4) strona bez własnej winy nie brała udziału w postępowaniu,
5) wyjdą na jaw istotne dla sprawy nowe okoliczności faktyczne lub nowe dowody istniejące w dniu wydania decyzji, nie znane organowi, który wydał decyzję,
6) decyzja wydana została bez uzyskania wymaganego prawem stanowiska innego organu,
7) zagadnienie wstępne zostało rozstrzygnięte przez właściwy organ lub sąd odmiennie od oceny przyjętej przy wydaniu decyzji (art. 100 § 2),
8) decyzja została wydana w oparciu o inną decyzję lub orzeczenie sądu, które zostało następnie uchylone lub zmienione.
Uchylenie decyzji z przyczyn określonych w art. 145 § 1 pkt 1 i 2 nie może nastąpić, jeżeli od dnia doręczenia lub ogłoszenia decyzji upłynęło dziesięć lat, zaś z przyczyn określonych w art. 145 § 1 pkt 3-8 oraz w art. 145a i art. 145b, jeżeli od dnia doręczenia lub ogłoszenia decyzji upłynęło pięć lat. Nie uchyla się decyzji także w przypadku, jeżeli w wyniku wznowienia postępowania mogłaby zapaść wyłącznie decyzja odpowiadająca w swej istocie decyzji dotychczasowej.
Można żądać wznowienia postępowania również w przypadku, gdy zostało wydane orzeczenie sądu stwierdzające naruszenie zasady równego traktowania, zgodnie z ustawą z dnia 3 grudnia 2010 r. o wdrożeniu niektórych przepisów Unii Europejskiej w zakresie równego traktowania (Dz.U. Nr 254, poz. 1700), jeżeli naruszenie tej zasady miało wpływ na rozstrzygnięcie sprawy zakończonej decyzją ostateczną.
Ponadto, zgodnie z art. 84b ust. 3 PrBud - w przypadku ustalenia przez organy nadzoru budowlanego, że zachodzą okoliczności uzasadniające wznowienie postępowania albo stwierdzenie nieważności decyzji wydanej przez organ administracji architektoniczno-budowlanej, właściwy organ administracji architektoniczno-budowlanej wznawia lub wszczyna z urzędu postępowanie.
4 Przesłanki ważności pozwolenia na budowę i najczęściej spotykane w praktyce przyczyn uchylenia decyzji o pozwoleniu na budowę
Ogólne przesłanki ważności pozwolenia na budowę wynikają z art. 35 ust. 1 PrBud i przepisów k.p.a. Można choćby wymienić:
- zgodność pozwolenia na budowę z Decyzją Środowiskową i decyzją o lokalizacji inwestycji celu publicznego,
- zgodność z wymaganiami ochrony środowiska,
- zgodność projektu z przepisami techniczno-budowlanymi (np. przepisami RozpWarTechBud), czy z postanowieniami o dopuszczalnych odstępstwach jeśli wydane w trybie art. 9 PrBud,
- posiadanie wymaganych opinii, uzgodnień, pozwoleń, sprawdzeń przewidzianych przepisami szczególnymi (np. w zakresie wjazdu na drogę z zarządem dróg, pozwoleń wodno-prawnych przy wpływie inwestycji na stosunki wodne wg Prawa wodnego, pozwoleń na wyłączenie z produkcji rolnej, itp.),
- posiadanie informacji dotyczącej bezpieczeństwa i ochrony zdrowia,
- sporządzenie projektu budowlanego przez osoby mające wymagane uprawnienia budowlane i sprawdzenie projektu (jeśli wymagane). Wymagania odnośnie projektu budowlanego wynikają z kolei z art. 34 PrBud i aktów wykonawczych,
- przeprowadzenie postępowania o wydanie pozwolenia zgodnie z zasadami wynikającymi z k.p.a.
Jednak co do zasady, brak jest przepisów które określałyby precyzyjnie jakie przesłanki musi spełniać pozwolenie na budowę aby było ważne. Wynika to z faktu, że zakres zastosowania, w toku postępowania, różnych regulacji prawnych zależy od rodzaju inwestycji (inne dla domu jednorodzinnego a inne dla zakładu produkcyjnego czy biurowca). W sprawie ITPOK zajdzie np. potrzeba:
- stosowania przepisów UstInforŚrod z zakresu udziału społeczeństwa w postępowaniu o pozwolenie na budowę,
- rozpatrywania wniosków i uwag zgłoszonych przez społeczeństwo (niekoniecznie przez strony),
- spełnienia warunków powołanych w decyzji o lokalizacji inwestycji celu publicznego (np. w zakresie dróg komunikacyjnych),
- spełnienia wymagań przewidzianych Decyzją Środowiskową w zakresie np. „ponownej analizy sposobu zagospodarowania odpadów poprocesowych ze szczególnym uwzględnieniem odpadów stabilizowanych” (str. 16 Decyzji Środowiskowej),
- prawdopodobnie przeprowadzenia badań geologiczno-inżynierskich gruntu, gdzie ma zostać zlokalizowany ITPOK.

A zatem to w szczególności niedotrzymanie warunków wyżej określonych może być przyczyną uchylenia decyzji o pozwoleniu na budowę. Formułowanie katalogu wszystkich możliwych przyczyn uchylenia decyzji o pozwoleniu na budowę jest zadaniem skomplikowany, niemniej te najczęstsze będą wynikały właśnie z naruszenia wyżej powołanych warunków art. 35 PrBud, i art. 34 PrBud w odniesieniu do projektu budowlanego.

Premises, procedure, and dates of appealing against the building permit – in what time perspective one may appeal against/annul the building permit.
Please, also describe the conditions (premises) of validity of the building permit and the most frequent reasons (in practice) for its annulment (revoking).
1 Entities authorized to file an appeal
Construction works may start based on the final decision on the building permit; the decision is final and cannot be appealed against (Art. 16 § 1 of the Code of Administrative Procedure). Such situation occurs, as to the principle, when the period for filing an appeal already lapsed (and was not restituted), or the decision on the building permit was upheld in force as a result of examination of an appeal by the II instance body (complaint to administrative court does not stop – as to the principle – enforcement of the decision). The issue of granting the decision on the building permit the rigor of immediate enforceability raises legal doubts. Consequently, we will not discuss the option, where the building permit for ITPOK is issued with the rigor of immediate enforceability.
The parties may appeal against the decision of the building permit within 14 days from delivery or announcing the decision. Only a party to the proceedings may file an appeal against the decision on the building permit. As to the principle, pursuant to Art. 28, Section. 2 of the Construction Law (hereinafter “CL”), the parties to the proceedings for the building permit are: the investor and the owners, holders of perpetual usufruct or managers of real estate located in the impact zone of the facility. The Supreme Administrative Court stated in its ruling of 9 October 2007, file no. II OSK 1321/06 “the impact zone of the facility should be determined with consideration given to the form, construction of the projected facility and other characteristics thereof and the manner of developing the area neighboring the projected investment, taking into account the content of orders and bans contained in the separate regulations". Therefore, it is necessary to develop, each time, the separate regulations, which introduce the anticipated limitations in the free use of real estate due to the erection in the neighborhood of a specific construction. Only limitations in the development of real estate resulting from a particular provision of law provide a basis for participation in the proceedings aimed at issuing the decision on the building permit, as only in such situation we deal with the occurrence of legal interest. Limitations, which do not result from the provisions of law, do not constitute a basis for considering an entity a party to such proceedings, since the factual interest occurs here and not the legal interest (the same – rulings of the Supreme Administrative Court of 25 September 2008, II OSK 1058/07; of 16 March 2009, II OSK 1540/08, II OSK 12/08; of 4 September 2009, file no.. II OSK 1349/08, ruling of the Provincial Administrative Court in Lublin of 25 September 2009, file no. II SA/Lu 322/09). Therefore, CL materially limits the possibility of being granted the status of a party to the proceedings for the building permit, and, consequently – possibility of filing an appeal. CL also excludes (as to the principle) from participation in the proceedings for the building permit the ecological organizations, which often (in practice) filed appeals (Art. 28, Section 3 of CL).
Nevertheless, the aforementioned limitations in the status of a party set forth in Art. 28, Section 2 and Section 3 of CL are not applicable to the proceedings for the building permit, which require participation of the public according to the provisions of the Act of 3 October 2008 on the Provision of Information on the Environment and its Protection, Public Participation in Environmental Protection and Environmental Impact Assessment (hereinafter “AIE”). In such case the provisions of AIE and general provisions of the Code of Administrative Procedure on a party (Art. 28) are applied. It follows from the decision on environmental conditions of 15 April 2010 issued for ITPOK (hereinafter “Environmental Decision”) that the investor was obliged to carry out the repeated environmental impact assessment under the proceedings for the building permit (p. 16 and p. 36 of the Environmental Decision) in connection with the decision of the Regional Director of Environmental Protection (based on Art. 77, Section 5 of AIE). Pursuant to Art. 3, Clause 8) letter c of AIE – proceedings regarding assessment of environmental impact of the planned project cover, in particular, ensuring public participation in the proceedings . Consequently, it should be assumed that those ecological organizations and other entities, which prove the fulfillment of criterion of the legal interest within the meaning of Art. 28 of the Code of Administrative Procedure may participate in the proceedings as a party. Based on Art. 44, Section 1 of AIE – ecological organizations, which, referring to their statutory goals, announce the intent to participate in the proceedings for the building permit (requiring the public participation), will participate in these proceedings as a party. Pursuant to Art. 44, Section 2 of AIE – ecological organization has the right to file an appeal against the decision issued in the proceedings requiring the public participation, if this is justified by the statutory goals of this organization, also in the case when such organization did not participate in particular proceedings requiring the public participation conducted by the first instance body; filing an appeal is equal to announcement of the intent to participate in such proceedings. Such organization participates in the appeal proceedings as a party.
It follows from justification of the Environmental Decision (p. 22-23) that five ecological organizations participated in the proceedings for the issuance thereof. It may be expected that these organizations will also participate in the proceedings for the building permit and will file appeals, if their comments/conclusions are not accepted. It follows from justification of the Environmental Decision (p. 33 and the subsequent ones) that the investment is located in the neighborhood of the areas of habitat protection Natura 2000: fortifications in Poznań, which are a wintering place of bats. It was stated in the Environmental Decision that ITPOK would not have a negative impact on bats (potential risk of noise), but the very fact of their occurrence may cause interest of ecological organizations in participation in the proceedings and filing appeals.
Moreover, in the proceedings requiring the public participation (and proceedings for the building permit for ITPOK will be most likely such type of proceedings) everyone is entitled to file comments and conclusions (Art. 29 and Art. 5 of AIE). This does not automatically mean the right to file an appeal against the decision on the building permit (since the criterion of the legal interest has to be also met), but may prolong the procedure of the issuance of the permit. Pursuant to Art. 30 of AIE – administration bodies applicable for issuing the decision or developing the draft documents, with respect to which the provisions of this Act or of other Acts require ensuring participation of the public, ensure the public participation, respectively, prior to the issuance of these decisions or amendment thereof and prior to acceptance of these documents or amendment thereof. After filing comments and conclusions the applicable body:
1) analyzes the comments and conclusions filed by the public ;
2) attaches to the accepted document the justification containing the information on the public participation in the proceedings and on the manner in which the comments and conclusions filed in connection with the public participation were taken into account or accepted.
It is worth mentioning that in the Environmental Decision the description of the filed comments and investor’s responses to these comments takes more than 100 pages, which illustrates the influence of “the public participation” on the date of issuing the decision on the building permit.
2 An appeal against the decision on the building permit, periods for filing an appeal, a complaint to the administrative court
An appeal against the decision on the building permit issued by the president of the city is examined by the governor (there is a certain category of investments, with respect to which the building permit is issued, in the first instance, by the governor – Art. 82, Section 3 of CL). An appeal may be filed only by a party to the proceedings for the building permit (see: point 1 of this study) within 14 days from delivery or announcement of the decision. Appeal is filed through the first instance body.
An appeal does not require a detailed justification. It is sufficient if it follows from the appeal that the party is not satisfied with the issued decision (Art. 128 of the Code of Administrative Procedure). In practice, entities filing appeals in the cases for the building permit often refer to the infringement of the general rules of the Code of Administrative Procedure (Art. 6 – 16), including:
- the rule of legality,
- the rule of objective truth,
- the rule of strengthening confidence,
- the rule of providing information,
- the rule of hearing the parties.
Infringement of these rules is more simple to justify and although it usually does not constitute a basis for a definitive deprivation of the investor of the possibility to keep the building permit in force, it may convince the second instance body to waive the decision and to send the case to be examined once again by the first instance body, which will significantly extend the time of the proceedings.
Quite often a basis for an appeal are the provisions of the Ordinance of the Minister of Infrastructure of 12 April 2002 regarding technical conditions, which buildings and their location should comply with (hereinafter “OTCB”) including, without limitation: extensive shadowing caused by the erected facility, extensive noise, a failure to comply with the norms of fire safety, etc. The appealing parties conduct a thorough analysis of the construction design and indicate, where it is incompliant with OTCB.
In the cases, where regulations on protection of the environment play a material role (and ITPOK undoubtedly belongs to them) a frequent basis is the provisions of acts regulating the environment and its protection, including those regarding: noises, odors, impact on water conditions, etc. In the discussed case, a list of potential arguments for appeals is contained in comments and conclusions filed in the course of proceedings for the Environmental Decision and these arguments are described there.
Filing an appeal within the determined period withholds enforcement of the decision (Art. 130 § 2 of the Code of Administrative Procedure), i.e. possibility of commencing the construction works covered by the building permit. The state administration body, which issued the decision, informs the parties about filing an appeal.
An appeal should be examined by the second instance body within the periods set forth in Art. 35 of the Code of Administrative Procedure, i.e.:
- the cases, which may be examined based of the evidence presented by the party together with the request regarding instituting the proceedings or based on facts and evidence, which is publicly known or known ex officio to the body, before which the proceedings are carried out, or are possible to determine based on the data at the disposal of this body, should be dealt with immediately,
- the case requiring the explanatory proceedings should be dealt with not later than within a month, and a particularly complicated case – not later than within two months from the date of instituting the proceedings, and in the appeal proceedings – within one month from the date of receipt of the appeal,
- nevertheless, the aforementioned periods do not include the periods provided for in the provisions of law for performing specific actions, the periods of suspension of the proceedings and delays caused by the fault of the party or by reasons beyond the control of the administrative body.
Quite often examination of an appeal lasts much longer than the maximum period of one month set forth in the Code of Administrative Procedure.
It should also be mentioned that after exhausting the appeal measures set forth in the Code of Administrative Procedure (appeal), i.e. if, for example, the second instance body upholds the appealed decision on the building permit in force, the entitled party has the right to file compliant with the provincial administrative court (Art. 52 § 1 of the Act – Proceedings before Administrative Courts – hereinafter “PAC”). The period for filing a complaint is 30 days from delivery to the appealing party of the decision in the case or 6 months for the prosecutor or ombudsman. The complaint is filed through the body, the activity of which is the subject of the complaint. As to the principle, filing a complaint with the Provincial Administrative Court does not withhold the enforcement of the building permit (Art. 61 § 1 of PAC). However, in certain circumstances it is possible to withhold the enforcement of the building permit (Art. 61 § 2 and § 3 of PAC).
According to Art. 44, Section 3 of AIE – an ecological organization is entitled to file a complaint with the administrative court against the decision issued in the proceedings requiring the public participation, if this is justified by the statutory goals of this organization, also in the case, when it did not participate in particular proceedings requiring the public participation.
It happens in practice that the second instance body waives the decision on the building permit due to the infringement of the rules of the proceedings or lack of explanations of material circumstances and sends the case to be examined once again by the first instance body. The first instance body repeats the proceedings in the part defined by the guidelines of the second instance body and once again issues the decision on the building permit. This decision is once again appealed against by the party. After conducting the repeated appeal proceedings the second instance body upholds the decision on the building permit, but the party files a complaint with the Provincial Administrative Court with an application for withholding enforceability of the decision on the building permit (although it may be obliged to contribute a deposit to secure the claims of the investor according to Art. 35a of CL), and the Provincial Administrative Court, after more than a year long proceedings, waives the decision on the building permit. In such scenario, an analysis of the case regarding the application for the building permit lasts several years.
3 Annulment of the decision on the building permit; reinstituting the proceedings
Besides an appeal to the second instance body and the complaint to the Provincial Administrative Court, the demands regarding annulment or applications for instituting the proceedings de novo may be filed with respect to the legally valid decisions on the building permit.
Stating invalidity of the building permit
According to Art. 156 § 1 of the Code of Administrative Procedure – the state administration body states invalidity of the decision which:
1) was issued in breach of the provisions on applicability,
2) was issued without the legal basis or with a drastic violation of law,
3) relates to the case, which was previously settled pursuant to another final decision,
4) was addressed to a person not being a party in the case,
5) was unenforceable on the date of issuance thereof and this unenforceability is of a permanent nature,
6) in case of its enforcement it would cause the act threatened with a penalty,
7) contains a defect causing its invalidity pursuant to the provisions of law.
Invalidity of the decision for reasons mentioned in § 1 points 1, 3, 4 and 7 is not stated, if ten years lapsed from the date of its delivery or announcement or if such decision resulted in the irrevocable legal effects.
Pursuant to Art. 158 § 2 of the Code of Administrative Procedure – if invalidity of the decision may not be stated as a result of circumstances referred to in Art. 156 § 2, the state administration body will only state that the appealed decision was issued in breach of law and will indicate the circumstances, for which it did not state invalidity of the decision.
And pursuant to Art. 159 § 1 of the Code of Administrative Procedure – the state administration body applicable for stating invalidity of the decision will withhold ex officio or at the request of the party the enforcement of the decision, if probability occurs that it is subject to one of defects described in Art. 156 § 1.
Reinstituting the proceedings for the building permit
According to Art. 145 § 1 of the Code of Administrative Procedure – in a case ended with a final decision the proceedings are instituted de novo , if:
1) evidence, based on which the factual circumstances material for the case were determined, proved false,
2) the decision was issued as a result of an offence,
3) the decision was issued by an employee or the state administration body, which is subject to exclusion pursuant to Art. 24, 25 and 27,
4) a party did not participate in the proceedings not due to its fault,
5) the new factual circumstances essential for the case occur or new evidence occurring on the date of issuing the decision, which the body which issued the decision was not aware of,
6) the decision was issued without obtaining the position of another body, which is required by the provisions of law,
7) the initial issue was settled by the applicable body or court in a manner different than the assessment adopted for issuance of the decision (Art. 100 § 2),
8) the decision was issued based on another decision or court ruling, which was next waived or amended.
Waiving the decision for reasons set forth in Art. 145 § 1 clause 1 and 2 is not possible, if ten years lapsed from the date of delivery or announcement of the decision, and for reasons set forth in Art. 145 § 1 clauses 3-8, and in Art. 145a and Art. 145b, if five years lapsed from the date of delivery or announcement of the decision. Also, the decision may not be waived if, as a result of reinstituting the proceedings, only a decision corresponding in its essence to the current decision could be issued.
Reinstituting the proceedings may also be requested if the court issues a decision on violation of the equal treatment rule, according to the Act of 3 December 2010 on Implementation of Certain Regulations of the European Union Regarding Equal Treatment (Journal of Laws, No. 254, item 1700), if violation of this rule affected the conclusion in the case, which ended with the final decision.
Further, pursuant to Art. 84b, Section 3 of CL – if the construction supervision bodies state the occurrence of circumstances justifying reinstituting the proceedings or stating invalidity of the decision issued by the architectural-construction administration body, the applicable architectural-construction administration body institutes the proceedings de novo or ex officio.
4 Premises of validity of the building permit and the most frequent (in practice) reasons for waiving the decision on the building permit
General premises of validity of the building permit result from Art. 35, Section 1 of CL and provisions of the Code of Administrative Procedure. They include the following:
- compliance of the building permit with the Environmental Decision and decision on location of a public investment,
- compliance with the requirements of environmental protection,
- compliance of the project with the technical and construction regulations (e.g. provisions of the Ordinance on Technical and Construction Terms), or with decisions on admissible exceptions, if issued pursuant to Art. 9 of CL,
- holding the required opinions, agreements, permits, check-outs provided for in the special provisions (e.g. regarding entry to the road with the road management, water-legal permits re: impact of the investment on water conditions according to the Water Law, permits for exclusion from agricultural production etc.),
- possessing information on safety and health protection,
- preparation of the construction design by the persons holding the required construction license and review of the design (if required). The requirements regarding the construction design result from Art. 34 of CL and from secondary legislation,
- carrying out the proceedings for issuing the permit in accordance with the rules resulting from the Code of Administrative Procedure.
Nevertheless, as to the principle, there are no provisions, which would precisely define what premises [conditions] the building permit must meet in order to be valid. This results from the fact that the scope of applying, in the course of the proceedings, different legal regulations depends on the type of investment (different for a family house and different for a production facility or office park). With respect to ITPOK it will be necessary to:
- apply the provisions of AIE with respect to the public participation in the proceedings for the building permit,
- examine conclusions and comments filed by the public (not necessarily by the parties),
- meet the conditions referred to in the decision on location of a public investment (e.g. regarding communications routes),
- meet the requirements set forth in the Environmental Decision with respect to e.g. “a repeated analysis of the way of management of post-treatment waste with particular focus on stabilized waste” (p. 16 of the Environmental Decision),
- probably, carry out geological-engineering research of land, on which ITPOK is to be located.
A failure to perform the above actions could undoubtedly be used for filing an appeal, and, consequently, waiving the decision on the building permit by the second instance body. Therefore, a failure to fulfill the aforementioned conditions may be the reason for waiving the decision on the building permit. Development of the catalogue of all possible reasons for waiving the decision on the building permit is a complicated task, nevertheless, the most frequent ones result from default regarding the aforementioned conditions of Art. 35 of CL and Art. 34 of CL with respect to the construction project.
