In certain lending transactions, especially more heavily leveraged transactions, lenders may consider whether their ability to rely on a market disruption clause should act as a draw stop event. Draw-stop events usually include the occurrence of a Default (i.e. an event of default or a potential event of
default), failure to satisfy conditions precedent, and failure to comply with the representations and warranties at
the date of drawdown.
