(earlier on they mention that "la tutela interpuesta por la demandante se encuentra caduca...")

Statute of Limitations I could go on to add expiration of "statute of limitations", prescription sounds a bit literal from Spanish for me, but could be valid. But definitely we shall agree that the girls in Chile are quite pretty.

Time-barring As (BrE) mooted or (AmE) posited/postulated in my additional note:

we are hereby entering a plea of time-barring of the action for {and remedy of?} employment protection (Tom West III: labor relief).

I am still unclear whether e.g. in Chile where the girls are so pretty, only the procedural action and/or the underlying substantive remedy or right is barred.

PS prescription in EN land law connotes thE acquisition of squatter's rights/adverse possession. So I prefer the term of 'time limits', though Billh and members of the E&W Bar who have written textbooks on the subject definitely disagree with me.

What they are trying to say is that the complainant failed to bring an action within the 6 months following the incident, which was the time period stipulated by the law for filing a complaint for violation of fundamental rights of the worker. So the defendant is trying to say that the complaint is not valid. Any other ideas? Adrian, time-barring seems like the right concept but how would you phrase the above sentence "venimos en oponer excepción de caducidad de la acción de tutela laboral"? Thanks!

(AmE) Plea in bar

If e.g. Peruvian> plea of barring of he right and remedy, as opposed to prescripción extintiva where the remedy but not the right to sue is barred.

Commentators in Latin America may care to elaborate.

Caducidad de la acción: time barring of an action; expiration of statute of limitations 'on' a claim (Tom West III's ES>AmE glossary)

Thanks. But you also agreed with another answer. PS Granted plea in bar refers to reasons other than time limits, I've narrowed down my answer in the discussion entries to the 'plea of time-barring'.
