English term

may be alleged to

English to French Law/Patents Law: Contract(s)
Bonjour,

Dans le passage suivant, je ne vois pas commen traduire " may be alleged to " :
"The CONTRACTOR hereby agrees to indemnify and hold harmless PRINCIPAL for and against any losses, damages, liabilities and costs which PRINCIPAL may suffer or occur in connection with or resulting from any lien, charge, hold or similar claim or encumbrance upon the EQUIPMENT which any third party may hereafter claim or file as security for or against or in discharge of, debt, liability or charge which the CONTRACTOR may be alleged to or to such third Party, and PRINCIPAL shall have the right out of any amount, invoice by or otherwise due to the CONTRACTOR, any amount necessary to compensate an indemnify PRINCIPAL for all such losses, damages, liabilities and costs."

Merci à l'avance pour votre aide !

@ Asker Flawed source text! This simply does not make sense as it stands, there appears to be a chunk of text missing between 'alleged to' and 'or to'.

It's impossible to second guess what that text might have been, you need to check with your client. This is either inexcusably bad editing, or perhaps some text has been trunacted (missing line or end of line?), maybe due to OCR conversion of say a PDF document?

(accusation dont le contractant) pourrait faire l'objet

charge = accusation

alleged = accused without evidence submitted to a court

Peer comment(s):

disagree Germaine : hors contexte. Ici, c'est la créance, le passif ou la charge qui sont allégués.

aurait

Je comprends :

…as security for or against or in discharge of,
debt, liability or charge
which the CONTRACTOR may be alleged to or
[debt, liability or charge] to such third Party,…

To be alleged to [have a charge, debt…] : une créance, une dette qu’[il] aurait…

(ce qui est plus naturel et beaucoup moins lourd (dans une phrase déjà ambitieuse) que « une dette que l’Entrepreneur serait présumé avoir »)
