Hi PhB, you are probably right about what the definition is, for the logical reason that courts can only award two things -- money or some type of injunctive relief -- and this passage is clearly talking about money since it uses the word "paid."

But we still need a word or very short phrase that can be the "defined term" that is defined, elsewhere in the agreement, with something along the lines of what you've suggested (dommages et intérêts, etc.). I've suggested something below.

J'avais attiré l'attention de Lucia28 sur la majuscule et ce qu'elle implique plus tôt dans la conversation et j'aurais effectivement dû la reproduire dans ma suggestion. La définition, s'il y en a une, sera intéressante à lire et il y a peut-être interprétation de ma part en l'état (cf. NC3). Mais qu'est-ce qu'un tribunal ou un tribunal arbitral ou un médiateur accorderait d'autre que des dommages et intérêts dans un litige portant sur des droits d'auteur ?

It's capitalized despite being in the middle of a sentence, which means that it is a defined term in this contract. We need to know the definition in order to decide on a translation.

PhB's suggested translation below sounds like a possible definition of the term Award, but (1) we need to confirm what the definition is, and (2) we need a single word or very short phrase (a FR equivalent to "Award") that can stand in for that definition.

En effet Award est bien en majuscule. J'aurais plutôt tendance à opter pour dommages intérêts. En effet voici le restant du P4 "If litigation is necessary to establish such rights, X will advance all of the attendant court costs and attorney's fees, and any court or arbitrator or mediator Award of damages in excess of costs and attorney's fees will be paid to X"

je ne le vois pas dans l'extrait que vous citez et votre « etc. » nous cache peut-être qchose d'intéressant. Sinon, « décision de justice » serait une possibilité puisqu'on parle d'action en justice pour établir des droits, mais ça n'irait pas bien avec realize, à moins qu'il ne s'agisse de dommages intérêts attribués en application d'une décision de justice. Par ex. « le montant net des dommages intérêts attribués en vertu du paragraphe 4 ». Mouais... La majuscule qui commence Award indique-t-elle que le terme est défini dans votre document ?
