Hi PhB, you are probably right about what the definition is, for the logical reason that courts can only award two things -- money or some type of injunctive relief -- and this passage is clearly talking about money since it uses the word "paid."
But we still need a word or very short phrase that can be the "defined term" that is defined, elsewhere in the agreement, with something along the lines of what you've suggested (dommages et intérêts, etc.). I've suggested something below. |
