Cuestiones previas: Son mecanismos que tiene el demandado, de acuerdo con la ley, para exigir que se subsane algún vicio dentro del proceso o en su defecto se deseche la demanda por existir algún impedimento de la ley para proseguir con el juicio. Based on this definition, the best I can come up with is "(motion for) preliminary objection/challenge (by the defendant)". I can't find any suggested translations online. Can anyone come up with anything better (or green-light my suggestion)?

incidencia looks ambiguous : either the incidence or (Mex.) occurrences (Butterworths) incidents or events of a trial (Robb) or a mixture of both.

Presumably, the "incidencia" refers to the judge's examination of the motions (perhaps what we might see in Mexico as el desahogo de incidentes). Seems plausible to me in the context, though I might be completely wrong. No green light for either your suggestion or mine, sorry!

Preliminary question means an issue, including an issue raised as a defense, which is not an object of the proceedings but which the court must decide in order to determine whether to grant all or part of the relief requested.

'In May 2019 the Court made a decision by which the demand or claim made through the formalities of ordinary procedures, ordered the respondent or the defender to be summoned. Following on from the occurrence of previous issues, it states that in July 2021, the respondent or the defender presented a written response to the claim, which, in turn, proposed a counter-claim for damages against the claimants or applicants.'
In the mentioned case, the occurrence is of previous issues involved in the judicial process. By law the respondent or defender has the right to request a correction of an imperfection, a flaw or a mistake in the judicial proceedings, or, failing which, the application is dismissed. The request can be dismissed on the grounds that there is a legal impediment to proceeding with the trial.
