Spanish term

cuidados tuitivos

Spanish to English Law/Patents Law (general)
In a power of attorney from Spain granting care of a child to a relation for translation to UK English.

Escritura de apoderamiento, otorgada por XXX a favor de su hermano XXX para ***cuidados tuitivos*** del menor de aquella....

'Protective care' sounds wrong to me so I am wondering if 'care and custody', 'care and protection' or something similar would better convey the meaning of 'tuitivo'.

TIA.

@ Maria Elena and Neil Thank you both for your contributions. I have found the discussion interesting and it reflects what I found when I was doing my research. I think I am going to have to go with 'guardianship' only because it seems to reflect the meaning offered by DRAE better than educational custody. And I found another document which treated tuitivo and tutelar as synonyms. https://derechouned.com/libro/persona/211-los-cargos-tuitivo...

tutor / tutela Agree with Maria Elena - "tuitivos" relates to "tutela" i.e. "guardianship"

Guardianship

In Spain, the word "tutor" means guardian, as in the legal guardian of an underage child. It has nothing to do with tuition or education, but with the legal custody or guardianship of a child. "Cuidados tuitivos" refers to the legal protection provided by a guardian.

I think guardianship is the word that best conveys the meaning in English.
Note from asker:
Thank you. Again, later on in the document they do refer to 'guardian'.
And do you have any sources to back this up?

educational custody

The first reaction of my colleague and I was that "tuitivos" refers to tuition or education. Thus, the person in question would be charged not only with the care and protection of the subject, but also their educational welfare.

@Jane -> but it's specifically about the education aspect 0f care (guardianship = tutela).

Although I agree with Maria's solution, I can't bring myself to post an agree because she says that "It has nothing to do with tuition or education", a statement with which I beg to differ. On the contrary, it has everything to do with the child's upbringing, of which tuition/education will be an integral part.
Example sentence:

The “educational custody” is automatically given to fathers in Egypt in the absence of marital disputes

Provisional Educational Custody means that the grantee has all rights and privileges relative to the child's education.

Note from asker:
Thanks Neil. Later on in the document it does refer to the guardian being responsible for the child's education whereas the definition given by DRAE is 'Que guarda, ampara y defiende'.
