You have instructed me that you wish to act in a manner contrary to my advice. Whilst I do not think you should plead guilty, entering a plea is a choice only you can make. I shall do as instructed and inform the Court that you wish to change your plea from not guilty to guilty. At the bottom of this letter is a statement that you are acting against my advice, with a space for your signature. I should be grateful if you would sign this and ask the prison team to email the signed page back to me.

We agreed that I would enter a *plea on a limited basis* that you had no intention whatsoever to hurt, threaten or scare anyone, but you accept that by producing a knife in public, your behaviour, viewed objectively, amounted to conduct likely to cause a breach of the peace. If those remain your instructions, please sign where indicated on the document headed ‘Basis of plea’, which is the separate document sent to you along with this letter, in English with Romanian translation.

If the basis of plea is accepted, I expect you would be sentenced on your next appearance. Offences of this nature do not normally result in custodial sentences so I would ask the Court that your sentence be limited to time already spent in custody.

guilty plea este actul procedural în cadrulprocesului penal, în care inculpatul își recunoaște vinovăția; de regulă, să zicem că este acuzat prin trei capete de acuzare, procuratura îi oferă o opțiune să fie încadrat pentru o înfracțiune mai puțin gravă în schimbul recunoașterii vinovăției pentru faptă. Prin asta se evită un proces în instanță care costă bani și timp. În US, sistemul de condamnare este pe puncte cărora le corespund pedepsele în luni (nu ani). Deci, inculpatul își recunoaște vinoăția pentru o faptă inferioară.

In limited circumstances, the law allows for a form of plea bargaining where the prosecution agree in writing to proffering a more limited charge on condition of the accused pleading guilty.

B.6 A defendant may put forward a plea of guilty without accepting all
of the facts as alleged by the prosecution. The basis of plea offered
may seek to limit the facts or the extent of the offending for which
the defendant is to be sentenced. Depending on the view taken by
the prosecution, and the content of the offered basis, the case will
fall into one of the following categories:
(a) a plea of guilty upon a basis of plea agreed by the
prosecution and defence;
(b) a plea of guilty on a basis signed by the defendant
but in respect of which there is no or only partial
agreement by the prosecution;

(c) a plea of guilty on a basis that contains within it
matters that are purely mitigation and which do not
