Japanese to English Law/Patents Law: Contract(s) Company housing contract
Part of a company housing contract:

私の都合により入居から1年以内に社宅を退居する場合、社宅の修繕費用(現状回復費用)は私が負担致します。

What would be the appropriate translation for this term? Also, what exactly do they mean by "現状"... do they mean return the residence to the original condition, or recover from the current state of the residence, etc? The use of the word 現状 here seems a little odd to me.

Please advise as soon as you can!

It appears to be in wide use in Japan. It does mean "return to original (current) condition". In the US, the landlord would take a deposit, which would be applied to any necessary repairs or cleaning, then the different is refunded to you.

Damage fee

I don't really have a term, so I stated this as a note, but who am I to turn down a request, so here it is. The deposit in the US is called a "damage deposit", so I concocted the target term. You may be able to run with it.


It appears to be in wide use in Japan. It does mean "return to original (current) condition". In the US, the landlord would take a deposit, which would be applied to any necessary repairs or cleaning, then the different is refunded to you.

1 原状回復; 復旧; 不当利得の返還; 不当利得法
□元に戻すこと, 原状回復 (?restoration) を意味する言葉で, 法律上は, 被告の ?unjust enrichment (不当利得)の返還を請求する権利を基礎づける実体法的な一般的原理を意味する場合と, 被告の得た利益の返還という内容の救済を示す場合がある. 実体的な原理としての不当利得法の具体例には, コモン・ロー上の ?quasi contract (準契約)や, エクイティ上の ?constructive trust (擬制信託), ?equitable lien (エクイティ上のリーエン), ?subrogation (代位)などがある. 歴史的には, これらの法理を用いて領域別に発達してきた救済を, 大陸法を参考にしつつ restitution という一つの分野として把握したものである. 救済の内容を示す場合としては, 契約違反や不法行為に対する損害賠償の内容として, 原状回復をはかる場合などがある. この意味では, 契約が履行されたと同じ状態の実現をはかる ?expectation damages (履行利益の賠償)および原告が被告の約束を信じて出捐した損失分の回復をはかる ?reliance damages (信頼利益の賠償)と対比されて用いられる.
▲わが国の不当利得法との重要な相違点は, 利得の返還義務の範囲が原告の損失の範囲に限られないということである. もっとも, 英米でも restitution が被害者の損害を回復させることによる原状回復を意味する場合もあるので, 注意が必要である.
