Slučajevi u kojima se može zakonska hipoteka može nametnuti navedeni su u članu 563. Građanskog
zakonika. U skladu sa ovom odredbom, na zakonsku hipoteku imaju pravo:
– Ustupitelj ili svaki drugi otuđilac, na nepokretnostima koje su otuđene radi ispunjenja obaveza koja potiču iz otuđenja;

a) The legal mortgage.
The Article 563 of the Civil Code defines the cases in which a legal mortgage is imposed. According to this provision are entitled to a legal mortgage:
– the transferor and every other alienator, on the immovables alienated for the performance
of obligations arising from the alienation;

Article 431
 Debt secured by mortgage
1. If during the alienation of any real estate under mortgage it is agreed between the acquirer and the alienator that the acquirer will takeover the debt against the mortgage creditor, the mortgage creditor shall be deemed to have consented to the contract on takeover of debt if no denial of consent is issued thereby within three months of a written request by the alienator.

 Dug obezbeđen hipotekom
1. Kad je prilikom otuđenja neke nepokretnosti na kojoj postoji hipoteka ugovoreno između pribavioca i otuđioca da će pribavilac preuzeti dug prema hipotekarnom poveriocu, smatra se da je hipotekarni poverilac dao pristanak na ugovor o preuzimanju duga ako ga na pismeni poziv otuđioca nije odbio u roku od tri meseca od prijema poziva.

Article 13. Capital Gains
4. Gains from the alienation of any property other than that referred to in paragraphs 1,2 and 3, shall be taxable only in the Contracting State of which the alienator is a resident.
5. Gains from the alienation of any property other than that referred to in paragraphs
1,2, 3 and 4, shall be taxable only in the State of which the alienator is a resident.
