Destacado também que o precedente, por não ter generalidade e abstração da lei, não pode ser desconectado do caso concreto, assim qualquer tentativa de firmar tese, súmula ou súmula vinculante, com tentativa de abstração, poderá incorrer em sérios perigos.

Trata-se de mecanismo facilitador, no qual o relator apresenta de forma clara e inequívoca aquilo que pensa sobre o conteúdo da norma, sendo sugerível que a tese seja exaustiva em si, não sendo necessária a remissão a outro conteúdo para se fazer entender.

The following passage shows that "formação de precedentes" (the establishment of precedents) is not the same as "formação/fixação de teses jurídicas", which seem to be a result of established binding precedents.

"O intuito, mediante essa nova espécie de julgamento por amostragem e formação de precedentes[6] vinculantes, é proteger os princípios da isonomia e da segurança jurídica[7], estancando, desde logo, decisões conflitantes em matérias que a multiplicidade já se tornou latente, debatendo, no próprio segundo grau, a fixação de teses jurídicas, incutindo a estes, tal responsabilidade. Accordingly, footnote 6 of the same article confirms that they are not the same:

"[6] Será que é mesmo um precedente? Marinoni defende que é uma tese vinculante. Mas, há diferenças? Marinoni ao discorrer sobre o IRDR tece críticas sobre a sua formação e tenta, dentro da possibilidade jurídica existente do incidente, sistematizá-lo somente como maneira de formar teses jurídicas, nunca precedentes, por, não aceitar que os tribunais de segundo grau tenha essa incumbência." I am not 100% sure what the correct translation might be. I found a few instances of "establish legal theses", all of which seem to be pointing to Brazilian websites in English: https://www.google.com/search?q="establish legal theses"

In his Dicionário de Direito, Economia e Contabilidade (p. 391), Marcílio Moreira de Castro shows "thesis" as the translation for "tese", and "in theory" as the translation for "em tese".

And here is a very strong candidate:

"In 2022, the court established a legal theory known as the 'major questions doctrine,' setting the precedent that agencies have little leeway in creating new regulations with major economic impact or political salience that rely on powers not clearly laid out in statutory text."
